Article 1 – Definitions
1.1 Lessor: HOUSE OF EIGHTY8 B.V., operating under the name Studio88 Amsterdam, having its registered office in Amsterdam and registered with the Chamber of Commerce under number 93107722, located at Herengracht 215-1, 1016 BG Amsterdam.
1.2 Lessee: any natural person or legal entity who makes a reservation or uses the studio.
1.3 Studio: the space made available by the lessor, including all furniture, equipment, props, and facilities present.
1.4 Rental Agreement: the agreement between lessor and lessee established after confirmation of a reservation by the lessor.
1.5 Rental Period: the agreed period during which the lessee uses the studio.
1.6 Force Majeure: any circumstance beyond the control of the lessor that temporarily or permanently prevents the performance of the agreement.
Article 2 – Applicability
2.1 These terms and conditions apply to all offers, reservations, bookings, and rental agreements of Studio88 Amsterdam.
2.2 By placing a reservation, the lessee agrees to these terms and conditions.
2.3 Deviations from these terms are only valid if agreed upon in writing.
2.4 The applicability of any terms and conditions of the lessee is expressly excluded.
Article 3 – Reservation and Formation
3.1 A reservation is only final after it has been confirmed in writing or by email by the lessor.
3.2 The lessor reserves the right to refuse a reservation without stating reasons.
3.3 Obvious errors, mistakes, or typographical errors in offers, rates, or confirmations are not binding on the lessor.
3.4 The minimum booking duration is 1 hour and the maximum booking duration is 12 hours, unless otherwise agreed in writing.
Article 4 – Rates and Payment
4.1 All stated rates are exclusive of VAT unless explicitly stated otherwise.
4.2 A deposit of 50% of the total amount may be required when making a reservation.
4.3 The remaining amount must be paid no later than before the start of the booking or immediately after, as agreed.
4.4 In case of late payment, the lessor is entitled to cancel the reservation or deny access to the studio.
4.5 Additional booked time will be charged per hour at the applicable rate at that time.
4.6 All reasonable judicial and extrajudicial collection costs shall be borne by the lessee in case of non-payment.
TERMS & CONDITIONS
Article 5 – Cancellation and Changes
5.1 Cancellation or modification must always be made in writing or by email.
5.2 Cancellation or modification is free of charge up to 72 hours before the start of the booking.
5.3 In case of cancellation or modification within 72 hours before the start, the lessor is entitled to charge or retain the deposit.
5.4 In case of cancellation within 24 hours before the start or a no-show, the lessor is entitled to charge 100% of the booking amount.
5.5 Rescheduling is only possible subject to availability.
Article 6 – Use of the Studio
6.1 The lessee must use the studio carefully and leave it in the same condition as at the start.
6.2 It is not permitted to:
- smoke in or around the premises;
- use open flames, smoke machines, or flammable materials without permission;
- use liquids or materials that may cause damage;
- allow more persons than agreed;
- cause nuisance to neighbors or surrounding residents.
6.3 Furniture and props may be moved, provided they are handled carefully and returned to their original position afterward.
6.4 Setup and breakdown time are included within the booked time.
6.5 At least one responsible contact person from the lessee must be present during the booking at all times.
